By downloading, installing, accessing, activating, or using the Software, or by clicking “Agree,” “Accept,” or a similar button, you agree to be bound by this Agreement. If you do not agree to this Agreement, do not install, access, or use the Software.
For purposes of this Agreement:
“You” and “your” mean the individual or entity downloading, installing, accessing, activating, or using the Software. If you use the Software on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes that organization.
“BSP Technologies Parties” means BSP Technologies LLC and its owners, members, managers, officers, directors, employees, contractors, agents, licensors, service providers, successors, assigns, and affiliates.
“Documentation” means user guides, technical materials, support materials, release notes, website materials, and other documentation made available by BSP Technologies for the Software.
“Account” means any MacTain, BSP Technologies, payment-provider, identity-provider, or related account used to access, activate, purchase, validate, or manage the Software.
“Entitlements” means license status, subscription status, trial status, paid-feature access, activation state, usage limits, or other rights or limits associated with your Account, device, purchase, or license.
“Online Services” means hosted services, account services, license validation, entitlement checks, checkout, customer portal features, update services, support systems, analytics, crash reporting, websites, APIs, and other online functionality made available by or for BSP Technologies.
“User Content” means containers, images, volumes, files, workloads, logs, configuration, credentials, secrets, data, code, scripts, environment variables, or other content that you create, import, pull, store, mount, expose, transmit, run, or manage using the Software.
“Third-Party Services” means services, platforms, providers, processors, registries, repositories, marketplaces, networks, operating systems, frameworks, software, hardware, or content not controlled by BSP Technologies.
1. License Grant
Subject to your compliance with this Agreement and any applicable payment or license terms, BSP Technologies grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use the Software on Apple-branded computers that you own or control, solely for your personal or internal business use.
BSP Technologies reserves all rights not expressly granted in this Agreement. No rights are granted by implication, waiver, estoppel, exhaustion, or otherwise.
2. Ownership, Intellectual Property, and Marks
The Software is licensed, not sold. BSP Technologies and its licensors retain all right, title, and interest in and to the Software, Documentation, Online Services, websites, designs, interfaces, workflows, code, object code, source code, algorithms, models, databases, schemas, trademarks, service marks, trade names, trade dress, logos, domain names, goodwill, know-how, trade secrets, copyrights, patents, and other intellectual property and proprietary rights.
You do not acquire any ownership interest in the Software, Documentation, Online Services, MacTain brand, BSP Technologies brand, or any related intellectual property. You may not use BSP Technologies' or MacTain's names, marks, logos, domain names, product names, trade dress, or branding except as expressly authorized in writing by BSP Technologies or as permitted by law.
Nothing in this Agreement transfers ownership of your User Content to BSP Technologies. You grant BSP Technologies the limited rights necessary to operate, secure, support, validate, improve, and provide the Software, Online Services, licensing, support, and related functionality, subject to the Privacy Policy.
3. Free Tier, Paid Licenses, and Feature Limits
MacTain may offer a free tier, trial tier, paid license, subscription, or other licensing model. Your access to certain features may depend on the license type associated with your account, device, activation key, purchase, or subscription.
The free tier may include limits, including but not limited to limits on containers, volumes, port mappings, networking features, registries, blueprints, advanced functionality, or other product capabilities.
Paid licenses may unlock additional functionality for the applicable license term. Unless otherwise stated at purchase, a paid license does not grant ownership of the Software and does not guarantee access to future major versions, separately sold features, paid add-ons, Online Services, support, or services outside the scope of your purchased license.
We may change feature availability, license tiers, or product packaging over time. Changes will not retroactively reduce access you have already paid for during an active license term, except where necessary for security, legal compliance, technical integrity, abuse prevention, or discontinuation of unsupported functionality.
4. Pricing, Plan Changes, and Business Model Changes
MacTain prices, discounts, promotions, free-tier limits, trial terms, paid-plan features, subscription periods, renewal terms, taxes, and fees may change over time. Any price change for an active paid subscription will apply prospectively and will not increase the price for the then-current paid subscription period unless you expressly agree, the purchase flow permits the change under applicable law, or the change is required for legal, tax, payment-provider, or regulatory reasons.
If your license renews automatically, the renewal may occur at the then-current price and terms after any notice required by applicable law or the purchase provider. You are responsible for reviewing renewal terms and cancelling before renewal if you do not accept the renewal price or terms.
BSP Technologies may change MacTain's business model, including by moving some or all features from paid to free, moving free features to paid or limited tiers, discontinuing paid tiers, grandfathering existing users, offering replacement plans, changing trial availability, or ceasing to charge for the Software. Unless required by law or expressly stated in writing, these changes do not entitle you to refunds, credits, cash-outs, price matching, ongoing paid support, continued access to discontinued features, continued access to prior pricing, or parity with other users, plans, promotions, or future offerings.
5. Additional Terms and Order of Precedence
Certain purchases, Accounts, Entitlements, Online Services, support offerings, beta programs, third-party payment flows, or separately sold features may be subject to additional written terms, order forms, checkout terms, provider terms, product-specific notices, open-source licenses, or supplemental agreements. If there is a conflict, the more specific additional terms control only for the subject matter they cover, and this Agreement controls for all other Software use.
Open-source licenses control only for the applicable open-source component. Third-party provider terms control only for the applicable Third-Party Service or transaction handled by that provider. No purchase order, procurement term, vendor portal term, or similar document modifies this Agreement unless BSP Technologies expressly agrees to it in a signed writing.
6. License Activation and Validation
The Software may require activation, periodic license validation, or communication with MacTain licensing services or third-party payment providers to confirm your license status.
You agree not to bypass, disable, tamper with, or circumvent any license-management, activation, entitlement, usage-limit, or access-control mechanism in the Software.
If your license expires, is cancelled, is refunded, is reversed, cannot be validated, or is otherwise no longer active, the Software may automatically revert to a free tier, restrict functionality, disable paid features, or apply other license-based limits.
7. Updates and Compatibility
MacTain may provide updates, patches, fixes, or new versions of the Software. Some updates may be required for security, compatibility, licensing, or continued use of online services.
Updates may modify, add, or remove features. We do not guarantee that every version of the Software will remain compatible with all versions of macOS, Apple hardware, container runtimes, virtualization technologies, third-party tools, container images, registries, or external services.
You are responsible for maintaining appropriate backups and confirming compatibility before updating the Software or your operating system.
8. Permitted Use
You may use the Software to create, configure, manage, start, stop, monitor, and remove local containers, volumes, networks, blueprints, registries, images, ports, and related resources, subject to this Agreement and the limits of your license.
You are solely responsible for the containers, images, services, workloads, data, files, secrets, credentials, ports, network exposure, and software that you create, import, pull, mount, expose, run, or manage using MacTain.
9. Restrictions
You may not:
1. Copy, reproduce, distribute, sell, lease, rent, lend, sublicense, assign, or transfer the Software except as expressly permitted by this Agreement.
2. Reverse engineer, decompile, disassemble, modify, adapt, translate, or create derivative works of the Software, except to the extent such restriction is prohibited by applicable law.
3. Remove, obscure, or alter any copyright, trademark, attribution, license, or proprietary notice.
4. Use the Software for copyright infringement or to violate any law, regulation, third-party right, platform policy, export-control restriction, or applicable license.
5. Use the Software to operate malware, botnets, credential theft, unauthorized scanning, denial-of-service activity, exploitation, evasion, or other harmful or unlawful activity.
6. Circumvent license limits, usage limits, entitlement checks, activation systems, paid feature restrictions, or technical protections.
7. Use the Software to provide hosted, managed, commercial, or service-bureau access to third parties unless expressly authorized in writing by BSP Technologies.
8. Interfere with the Software’s security, integrity, telemetry controls, update process, licensing systems, or normal operation.
9. Misrepresent your identity, license status, organization, or authorization to use the Software.
10. Benchmark, scan, probe, or test the Software or Online Services in a way that could harm, degrade, bypass, or interfere with BSP Technologies' systems or other users, except as expressly authorized in writing.
11. Use the Software or Online Services to train, develop, or improve a competing product or service by copying protected expression, interfaces, workflows, proprietary behavior, or confidential information, except to the extent such restriction is prohibited by applicable law.
12. Access or use non-public APIs, unreleased features, internal endpoints, hidden functionality, source code, signing material, entitlement data, or diagnostic data unless expressly authorized by BSP Technologies.
Because unauthorized use, copying, disclosure, circumvention, or misuse of the Software may cause irreparable harm to BSP Technologies, BSP Technologies may seek injunctive or equitable relief for actual or threatened violations of this section without proving monetary damages and without posting bond, to the extent permitted by law.
10. Containers, Images, Workloads, and Third-Party Software
MacTain may allow you to pull, import, build, run, configure, or manage third-party container images, applications, services, packages, registries, operating-system components, and other software.
Third-party software is not part of MacTain unless expressly stated by BSP Technologies. BSP Technologies does not control, review, endorse, warrant, maintain, or assume responsibility for third-party images, workloads, registries, packages, containerized applications, or services.
You are solely responsible for:
1. Selecting trustworthy images and software.
2. Reviewing and complying with third-party licenses.
3. Managing secrets, credentials, tokens, certificates, and environment variables.
4. Securing exposed ports, networks, services, APIs, and volumes.
5. Backing up important data.
6. Complying with laws, regulations, and third-party terms.
7. Understanding the effect of starting, stopping, deleting, upgrading, exposing, or modifying containers and volumes.
11. Volumes, Files, Data, and Backups
MacTain may create, mount, modify, move, delete, attach, detach, or manage volumes, bind mounts, configuration files, logs, databases, runtime files, and other local resources.
You are responsible for maintaining backups of your data. BSP Technologies is not responsible for lost, deleted, corrupted, overwritten, inaccessible, exposed, or unrecoverable data, including data stored in or used by containers, volumes, images, registries, mounted directories, or third-party applications.
Before deleting containers, volumes, images, blueprints, or other resources, you should confirm that you have exported or backed up any data you wish to keep.
12. Networking, Ports, and Security
MacTain may configure or assist with local networking, port mappings, proxies, sockets, gateways, container networks, name resolution, firewall-related behavior, and other network features.
Exposing services through ports, networks, proxies, or gateways may make those services accessible to other processes, users, devices, networks, or the internet depending on your configuration and environment.
You are responsible for understanding and securing any network exposure created through the Software. BSP Technologies is not responsible for unauthorized access, misconfiguration, insecure container images, vulnerable services, weak credentials, exposed secrets, open ports, or insecure networks.
Secure VPN Tunnel allows you to route selected container traffic through a provider-neutral WireGuard connection that you configure. MacTain is not a VPN provider, does not select or operate your WireGuard endpoint, and is not a party to the agreement between you and your VPN provider.
You are solely responsible for using Secure VPN Tunnel lawfully; for your workloads and content; for selecting a provider whose capabilities and provider terms meet your needs; for complying with those terms and third-party rights; and for securing and correctly configuring endpoints, routes, keys, credentials, local access, and published ports.
Secure Egress is designed to fail closed for selected protected containers when MacTain cannot prove their VPN protection. This design does not guarantee anonymity, uninterrupted VPN-provider availability or protection, zero leakage under every conceivable software, macOS, provider, network, endpoint, or configuration failure, or that Secure VPN Tunnel is legally suitable for your activity.
13. Privileged Operations and System Changes
Certain MacTain features may require elevated permissions, privileged helpers, system extensions, local sockets, background services, login items, command-line tools, or access to system resources.
By enabling those features, you authorize MacTain to perform the requested operations on your device. These operations may affect local resources, system configuration, networking behavior, containers, volumes, files, processes, or services.
You may be asked by macOS to approve permissions or authenticate privileged actions. You should only grant permissions if you understand and accept the requested operation.
14. Privacy and Data Collection
Your use of the Software is also governed by the MacTain Privacy Policy, available at: https://www.mactain.com/privacy.
The Software may collect or process information necessary to operate the product, validate licenses, provide updates, improve reliability, process purchases, respond to support requests, or diagnose crashes and errors, as described in the Privacy Policy.
MacTain does not claim ownership of your container workloads, local files, application data, or user-generated content.
15. Accounts, Credentials, and Suspension
You are responsible for maintaining the confidentiality and security of your MacTain account credentials, activation credentials, access tokens, recovery information, device access, and any third-party account or service credentials used with the Software.
BSP Technologies may suspend, restrict, deactivate, or terminate access to the Software, paid features, online services, license validation, support, or account features if we reasonably believe that: (a) your account, license, payment method, or use of the Software is fraudulent, abusive, unlawful, insecure, or unauthorized; (b) suspension is necessary to protect BSP Technologies, other users, third-party services, payment providers, infrastructure, or the Software; (c) your payment fails, is reversed, is charged back, or is suspected of fraud; (d) you violate this Agreement; or (e) suspension is required by law, regulation, court order, sanctions, export-control obligation, platform rule, or service-provider requirement.
16. Feedback
If you provide suggestions, ideas, bug reports, feature requests, comments, or other feedback about MacTain, you grant BSP Technologies a perpetual, worldwide, royalty-free, irrevocable license to use, reproduce, modify, distribute, and otherwise exploit that feedback without restriction or compensation to you.
17. Third-Party Components and Open-Source Notices
The Software may include, depend on, interact with, or be distributed with third-party components, open-source software, frameworks, libraries, tools, or services. Those components may be governed by separate license terms.
BSP Technologies will provide third-party notices or open-source license information where required. To the extent a third-party license grants you rights that conflict with this Agreement, the third-party license controls only with respect to that third-party component.
Nothing in this Agreement limits your rights under applicable open-source licenses.
18. Third-Party Services and Platform Dependencies
The Software may depend on, interact with, link to, or exchange information with third-party services, platforms, payment processors, merchant-of-record providers, account systems, operating-system features, Apple frameworks, container registries, package repositories, identity providers, update services, analytics services, crash-reporting services, email providers, or support tools.
BSP Technologies is not responsible for third-party services, platform changes, payment-provider decisions, app marketplace rules, registry availability, third-party account status, Apple hardware or macOS changes, network conditions, or external dependencies. Third-party services may change, suspend, discontinue, impose limits, charge fees, revoke access, or make changes that affect the Software.
19. Purchases, Renewals, Refunds, and Cancellation
MacTain purchases may be processed by BSP Technologies or by a third-party payment processor, merchant of record, app marketplace, or reseller. Your purchase may also be subject to that provider’s terms, refund rules, tax handling, and cancellation process.
If MacTain is sold as a subscription or recurring license, the purchase flow will identify the price, billing period, renewal terms, cancellation method, and other material terms before purchase. You authorize BSP Technologies or the applicable payment provider to charge the payment method associated with your account for recurring fees, taxes, and permitted charges until you cancel or the subscription otherwise ends.
Unless otherwise required by law or stated at purchase, cancelling a recurring license stops future renewals but does not automatically entitle you to a refund for the current paid term. Access to paid features may continue until the end of the current paid term unless otherwise stated. If a trial converts to a paid subscription, the purchase flow or provider terms will describe the trial period, conversion date, price, and cancellation process.
Refunds, chargebacks, reversals, payment failures, or suspected fraud may result in license deactivation or reversion to the free tier.
20. Availability, Support, Beta Features, and Discontinuation
BSP Technologies may provide support through documentation, email, community channels, issue trackers, or other methods. Support availability, response times, and scope are not guaranteed unless expressly stated in a separate written agreement.
We may decline support for unsupported versions, modified installations, unlawful uses, abusive behavior, third-party workloads, third-party services, or environments we cannot reasonably reproduce.
The Software, online services, license validation, updates, support channels, documentation, trials, free tiers, paid features, beta features, preview features, experiments, and integrations may be unavailable, interrupted, delayed, limited, modified, suspended, deprecated, or discontinued at any time. BSP Technologies does not provide any service-level agreement, uptime commitment, backup commitment, recovery-time commitment, or support commitment unless expressly stated in a separate written agreement.
Beta, preview, experimental, prerelease, or evaluation features may be incomplete, unstable, unsupported, changed without notice, or removed. You should not rely on beta, preview, experimental, prerelease, or evaluation features for production, business-critical, regulated, high-risk, or revenue-dependent workloads.
BSP Technologies will not be responsible for any failure or delay caused by events beyond its reasonable control, including natural disasters, war, terrorism, labor disputes, supply-chain disruption, internet or hosting failures, payment-provider failures, platform-provider failures, registry outages, denial-of-service attacks, malware, security incidents, governmental action, changes in law, or failures of Third-Party Services.
21. Termination
This Agreement remains in effect until terminated.
Your rights under this Agreement automatically terminate if you violate this Agreement, circumvent license controls, misuse the Software, fail to pay applicable fees, or otherwise lose authorization to use the Software.
Upon termination, you must stop using the Software and uninstall or delete all copies in your possession or control. BSP Technologies may deactivate licenses, Accounts, Entitlements, Online Services, update access, and support access associated with terminated rights, subject to applicable law and any provider terms.
Sections that by their nature should survive termination will survive, including sections addressing ownership, intellectual property, restrictions, fees owed, third-party terms, feedback, disclaimers, limitation of liability, indemnification, export compliance, governing law, venue, assignment, entire agreement, and any accrued rights or remedies.
22. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Software is provided “as is” and “as available,” with all faults and without warranty of any kind.
BSP Technologies disclaims all warranties, express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, quiet enjoyment, accuracy, reliability, availability, security, compatibility, and uninterrupted or error-free operation.
BSP Technologies does not warrant that the Software will meet your requirements, operate without interruption, be secure, prevent data loss, prevent production loss, identify all risks, avoid all vulnerabilities, remain compatible with third-party software, or function with every macOS version, Apple hardware configuration, container image, registry, runtime, network configuration, or workload.
The Software is not designed, certified, warranted, or intended for use in high-risk, safety-critical, life-support, emergency-services, medical, nuclear, aviation, transportation, industrial-control, critical-infrastructure, regulated, or production-critical environments where failure, interruption, error, data loss, security incident, or misconfiguration could lead to death, personal injury, property damage, environmental damage, business interruption, legal liability, or significant economic loss, unless BSP Technologies has expressly agreed to that use in a separate written agreement.
The Software and Documentation are not legal, compliance, tax, security, audit, backup, disaster-recovery, or professional advice. You are responsible for evaluating your own legal, compliance, security, backup, recovery, operational, and business-continuity obligations.
23. Limitation of Liability
To the maximum extent permitted by applicable law, the BSP Technologies Parties will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including damages for lost profits, lost revenue, lost business, lost goodwill, lost opportunity, lost savings, lost data, lost content, lost containers, lost images, lost volumes, lost configurations, business interruption, production interruption, service interruption, deployment failure, workload failure, data corruption, data exposure, credential exposure, security incident, unauthorized access, computer damage, network exposure, downtime, remediation costs, procurement of substitute goods or services, or cost of substitute services, even if advised of the possibility of such damages.
To the maximum extent permitted by applicable law, the BSP Technologies Parties' total aggregate liability arising out of or relating to this Agreement, the Software, Documentation, Online Services, support, Accounts, Entitlements, Third-Party Services, or related transactions will not exceed the greater of: (a) the amount you paid to BSP Technologies for the Software during the twelve months before the event giving rise to the claim; or (b) one hundred U.S. dollars.
Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.
24. Indemnification
To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless the BSP Technologies Parties from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:
1. Your use or misuse of the Software.
2. Your containers, images, workloads, data, services, networks, or exposed ports.
3. Your violation of this Agreement.
4. Your violation of law or third-party rights.
5. Your use of third-party software, registries, images, services, or dependencies.
6. Your failure to secure credentials, secrets, services, networks, or data.
7. Your User Content.
8. Any dispute between you and a third party relating to your use of the Software or Online Services.
9. Your selection or use of a VPN provider, WireGuard endpoint, credentials, or configuration.
25. Export Control, Sanctions, and Compliance
You may not use, export, re-export, import, sell, or transfer the Software except as authorized by applicable law, including U.S. export-control laws and sanctions regulations.
You represent that you are not located in, under the control of, or a national or resident of any country, region, entity, or person subject to restrictions that would prohibit your use of the Software.
BSP Technologies may deny, suspend, restrict, or terminate access to the Software, license validation, support, updates, accounts, or online services when required or reasonably appropriate for export-control, sanctions, anti-fraud, anti-abuse, platform, payment-provider, or legal-compliance reasons.
26. U.S. Government Users
If the Software is acquired by or on behalf of the U.S. Government, it is provided as “commercial computer software” and “commercial computer software documentation” and with only those rights granted to all other users under this Agreement.
27. Changes to this Agreement
BSP Technologies may update this Agreement from time to time. If we make material changes, we may notify you through the Software, website, email, release notes, or other reasonable means.
Continued use of the Software after an updated Agreement becomes effective means you accept the updated Agreement. If you do not agree to the updated Agreement, you must stop using the Software.
28. Governing Law and Venue
This Agreement is governed by the laws of the State of Florida, excluding its conflict-of-law rules.
Subject to any rights you may have under applicable consumer-protection law, any dispute arising out of or relating to this Agreement or the Software will be brought exclusively in the state or federal courts located in Florida, and you consent to the personal jurisdiction and venue of those courts.
To the maximum extent permitted by applicable law, any claim arising out of or relating to this Agreement, the Software, Documentation, Online Services, Account, Entitlements, support, or related transactions must be brought within one year after the claim accrues, or it is permanently barred.
29. Severability
If any provision of this Agreement is found unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.
30. No Waiver
Failure by BSP Technologies to enforce any provision of this Agreement does not waive its right to enforce that provision or any other provision later.
31. Assignment and Corporate Transactions
You may not assign or transfer this Agreement or your rights under it without BSP Technologies’ prior written consent.
BSP Technologies may assign, transfer, delegate, or sublicense this Agreement, the Software, Documentation, Online Services, related intellectual property, license records, acceptance records, account records, payment-provider relationships, support records, rights, and obligations in connection with a merger, acquisition, reorganization, financing, corporate transaction, sale of equity, sale of assets, sale or transfer of the Software or related business line, change of control, insolvency event, or by operation of law. Any successor or assignee may continue, modify, discontinue, or replace the Software subject to this Agreement, any updated agreement, and applicable law.
32. Entire Agreement
This Agreement, together with the Privacy Policy, any applicable purchase terms, third-party notices, and any additional terms presented at purchase or activation, forms the entire agreement between you and BSP Technologies regarding the Software and supersedes any prior or contemporaneous agreements about the Software.
The BSP Technologies Parties are intended third-party beneficiaries of the provisions in this Agreement that disclaim warranties, limit liability, provide indemnity, protect intellectual property, restrict misuse, or preserve rights and remedies.
